What New Jersey Asks of Every Employer in It

The county pages above cover what makes each local economy different. This is the part that doesn't change as you drive across the state — and it is where most of the employers who call us have quietly fallen behind.

New Jersey is among the most employee-protective states in the country, and crucially, several of its obligations have no small-employer exemption at all. An owner with four people on payroll in Barnegat carries duties that a business the same size in most other states simply doesn't. Almost nobody sets out to ignore them; they just never had reason to find out.

  • The Law Against Discrimination applies from your first employee

    There is no small-employer exemption. NJLAD reaches further than federal law on protected categories, and it applies whether you employ one person or one thousand — which routinely surprises owners who assume the federal 15-employee threshold protects them.

  • Earned sick leave applies to every employer, of any size

    New Jersey's Earned Sick Leave Law covers essentially every employer in the state regardless of headcount. Accrual, carryover, permitted uses, and notice all have to be tracked — and 'we're small and flexible about time off' is not a record when someone asks for one.

  • The Family Leave Act reaches past FMLA's threshold

    Federal FMLA starts at 50 employees. The New Jersey Family Leave Act covers employers with 30 or more, so there is a band of employers who owe state leave while believing they owe none.

  • Contractor status is decided by the ABC test

    New Jersey applies the ABC test, which is stricter than the federal economic-realities standard. A worker can be a legitimate contractor federally and an employee under New Jersey law — and misclassification is the highest-dollar exposure most employers carry.
